Girl who ran into bus shelter glass panel settles case for €86,000

A young girl who claimed she sustained a gash on her forehead when she struck the glass side of a bus shelter at a shopping centre has settled her High Court action for €86,000.

Victoria Wisniewska was running to a friend's car at the Liffey Valley Shopping Centre, Dublin, when it is claimed she struck the glass panel and fell back to the ground.

The girl's barrister, Conor Kearney BL, told the High Court she has been left with a nasty scar on her forehead as a result of the incident two years ago.
He said she had been to the cinema to see the Barbie movie with a friend. It was dark and raining when they came out of the centre and they ran to get in the car.

Victoria Wisniewska (aged 14) of Maynooth, Co Kildare, had through her father Wojciech Wisniewski sued Liffey Valley Management Ltd. The settlement, which includes €82,000 in general damages and the rest in special damages, was recommended by the Injuries Resolution Board.

The settlement is without an admission of liability.

In an affidavit to the court, Victoria's father, Wojciech Wisniewski, said his daughter was on August 13. 2023, running towards her friend's mother's car and ran into the glass side of the bus shelter. He claimed she was unable to see this as there was allegedly no lighting and it was allegedly not evident that there was a glass panel in her path.

All of the claims are denied by Liffey Valley Management Ltd.

Victoria was brought to hospital where the cut was cleaned and closed with glue and steri strips and she was prescribed antibiotics. Mr Wisniewski said she was discharged home and is now left with a 5cm scar on her forehead.
The gash is well healed but she may require revision surgery when she is older. Mr Wisniewski said he was happy with the assessment by the Injuries Resolution Board.

Approving the settlement Ms Justice Nuala Jackson who examined the scar said the incident had been upsetting for all involved.
