Car Dealer Warranty

A friend of mine bought a 5 year old car from a dealer 2 months ago. He paid €9000 and got a warranty on the gearbox and engine. However, he believes that since he bought the car the clutch has become stiffer and although it drives well enough he finds it heavy on his leg. He went back to the dealer and he was told that it wasn't covered under the warranty given. Has he any come back on this or any avenue to appeal. I don't think he has but would be interested in the experiences of anyone out there. Southern law applies.

What you do is go to http://www.courts.ie/courts.ie/Library3.nsf/6556fea313d95d3180256a990052c571/224d3f40a61421d280256da6002eb56b?OpenDocument and download a form.  that is assuming he paid for the car out of a private and not a business account because it only applies to private transactions.

Then, fill in the form saying,  " I bought ....bla bla ... and it was agreed the car was fully guaranteed etc.

Then, without wasting 15 euro sending the claim in for assesment, send a copy to the garage saying the claim outlined defines your understanding of the terms and conditions at the time of purchase and I am giving you the opportunity to state your case to me before I send it in.

If he tells you to fcuk off, do just that and buy a new clutch.
If he looks worried you have him by the balls.

Bud - The warranty wasn't a full warranty, only gearbox and engine.

Would there be any point in him pursuing the court route if he did tell him to F*ck off or would he be waisting his time?

The clutch isn't under warranty so i wouldn't think there is anything that your mate can do.

You'd think if the dealer was any kind of businessman he'd have a look at it any way and do his best for the chap - make it far more likely to get repeat business from him and his friends. Now your mate will tell everyone that dealer is a shower of feckers and steer clear.

Given how hard it is to shift cars these days, I'd imagine your mate would have got a full warranty if he'd pushed for it when buying the car....
