It's not that straightforward. There's a set of tests called the Pritchard criteria. An individual is not fit to stand trial unless they can do all of the following.

1. Understand the charge(s) against them.
2. Decide whether to plead guilty or not guilty.
3. Exercise the right to challenge a juror.
4. Instruct solicitors and counsel — importantly, to communicate instructions effectively throughout the proceedings.
5. Follow the course of the proceedings.
6. Give evidence in their own defence.

So it's possible that she is and always has been able to instruct her legal team.  Although I think that's far from a guarantee.

The timing of this coming outside the 28 day limit makes me think that she isn't fit to give instructions on which case any decision on appeal becomes more complex and time consuming and may ultimately have been taken without her express instructions.

Well that was what the Crown submitted it to be a 10 year case. I imagine the defence would have submitted significantly less.

I would have thought between 6 and 8 years but I'm not sure I have enough info to accurately say
