I hadn't been following this case closely and just realised today that it was in Dublin. How can a Dublin court enforce a judgement against the BBC which is based in the UK? Could someone sue RTE for something they said in a London court?

If BBC is viewed in the 26 counties, which it is through contracts with a variety of cable providers, then it cannot slander people there.

Viewers from the South also saw the programme and as bbc say themselves, Gerry and his legal team saw an action in the South as having a better chance of success

No legal aid for defamation. All self funded.

Program was published north and south hence why it could be taken in the south. Better chance ace of success as well as was before a jury. While it does happen in the North the judge has a wide discretion to do the hearing without a jury. In the South the hearings are nearly exclusively before a jury therefore they are more sympathetic generally.

100%. This has potential to seriously damage them electorally. Not fit for purpose and full of ex RUC cnuts at top level. A leopard that hasn't changed its spots. SF might argue its finance ministers have squeezed the bastards financially, but party has still let PSNI away with murder,literally,as regards their obstruction of legacy cases involving the state.

Regardless of where the jury's sympathies might lie in this case, when I read the judges summary to the jury, effectively clearing out the clutter,  I thought it would be a slam dunk verdict in favour of our Gerry. It was then just a question of the amount of damages to be awarded.
It's in the amount of the damages awarded that determined the extent of the "sympathies".

Allegedly the BBC Legal team pleaded with the jury not to award costs to Adams.

They knew their goose was cooked and tried to mitigate the costs..

Imagine having Michael McDowell as a witness, Did the BBC he was of some sort of moral standing with what is supposed to be a young enough jury?

I get the whole protection of sources part of journalism within reason, but when you quote someone who wasn't even at this alleged meeting where Adams is meant to give the order and it was only 3rd hand at best heresay.

I wonder who had the brain storm to call Michael McDowell as a witness for the defense, one of Ireland's most repellent politicians. He inspires derision. The judge pretty much diminished into insignificance the relevance of his and others' historical anecdotal testimony about Gerry and the IRA pre GFA. That what was solely of import was Gerry in 2016. He more or less stated that in our civil war of 1922,  some participants might have been on the wrong side of what was the law then but post civil war later participated in the Dail and acted reputedly. I wonder was he thinking of the notorious scoundrel De Valera? The judge also laid out what the jury could award in damages should they be so inclined, with the lowest damage to rep worth  say 10k, for regular damage to reputation  around 100k and a serious libel award would be in the range of 300k.
