Title: Latent Defect issue
Post by: tintin25 on August 23, 2019, 10:58:57 AM
Hi,

Appreciate if any of the legal heads on here could give me some advice.

Got a letter yesterday from the FSCS stating that the company that my developer had used for latent defect insurance had gone into liquidation and they attached a refund of premium for the unexpired term of the policy for my property (purchased last year - new build).

As it stands I have no cover and not sure what the options are?  What are the implications etc?

Any advice would be appreciated.

Thanks

I'm not that well informed on latent defect insurance, if you provide a little more detail i'll try and assist.
Did you purchase the house in the North or in the south
Was there an insurance warranty provided and if so by whom and did it only cover latent defects
Is the developer that you purchased the property from still trading
Are there any defects apparent that need addressed, if there are have you approached the developer
Have you asked your solicitor what your options are
