I honestly think this  is all down to  the road linking Donegal with Monaghan/Dublin. No other reason  for these challenges other than  pure  bigotry. Insecure  unionists thinking it's yet  another step towards a United Ireland.

The same with the hourly enterprise train. East Belfast residents want the amount  of  trains  heading to and from Dublin reduced .

Anyone with half a brain cell can  see how  good both situations  are/would be for people's safety,  the economy, jobs, tourism, the environment  etc etc. But no , the Union Jack tinted  glasses  are always on

Fresh proceedings have now been brought by nine individuals against the Department for Infrastructure (DfI).

They claim the decision to begin the initial phase breaches legislative goals for cutting greenhouse gas emissions in Northern Ireland.

The Climate Change (NI) Act 2022 contains a series of interim targets moving towards achieving net-zero emissions by 2050.

According to lawyers representing the group, approving part of the A5 scheme is irrational and an unlawful breach of the Climate Change Act.

Further grounds of challenge allege a breach of planning regulations; a breach of habitats regulations by failing to take an appropriately precautionary approach to the impact on the Tully Bog conservation area; a failure to further consult the public; and a breach of the group's Article 8 human rights.

The court also heard that the applicants are seeking a protective costs order which would impose a cap on any legal bill.

None of them attended the preliminary hearing to timetable the case on Tuesday.

This is the only way to sort this. Make it so expensive to launch spurious appeals that they think twice, no matter how well funded they are.

This is the only way to sort this. Make it so expensive to launch spurious appeals that they think twice, no matter how well funded they are.

Dangerous precedent that to set. Restrictive costs orders are not cheap as is but they are a necessary tool.

I'm not in the country at the moment so can't be sure but it seems the case has been granted leave. Whilst that's said to be a modest bar, our courts have been much stricter on the leave threshold in recent years. Basically the Judge must be satisfied that there is at least an arguable case with a reasonable prospect of success. Spurious legal actions just don't get leave.
