Having sensible sanctuary policies in place is the answer.

Make it safe for illegals to engage and cooperate with the authorities without fear of being arrested and deported for offering a statement or making a victim complaint.

Deport the criminal ones after they serve their sentences.

That said, without knowing anything about his personal circumstances, I think he probably should have been handed over on the grounds that he had been deported twice before.
